What is an act of God?

We named this website after a insurance term once used to refute insurance claims...  


The Collins English dictionary defines ‘an act of God’ as:

‘An event that is beyond human control, especially one in which something is damaged or someone is hurt.‘

When discussing home insurance , the term ‘act of God’ is often used as a catch-all phrase for natural disasters or events that cause damage to a property. 

The most common criteria for an ‘act of God’ should be:

  • Unpredictable
  • Unpreventable
  • Unavoidable
  • An act of nature
  • Not linked to any human actions, lack of maintenance or negligence 

What is the purpose of this website?

What it is:

It is an informative website aimed at educating the public on difficult legal matters relating to short term insurance. 


What it is not:

The purpose of this website is not to defame anyone, or any company. 

We plan to publish the raw “truth for public benefit”

Every statement we will make will be factually and substantially true, and we will publish it for the sole purpose of public benefit. 


How will it work:

We will interview some of the best legal minds and publish informative podcasts.

We will provide informative articles written by legal professionals that will educate us on how legal insurance pitfalls affect our daily lives.

Join our family's journey, over the past year and following months, as we prepare for a epic battle, with the insurance subsidiary of one of the largest financial services companies in South Africa.

We are fighting for justice, and to get them to do the right thing. 

What happened?

We changed insurance companies after 17 years and somehow with the transfer of the policy, our building and structural insurance was omitted! 


Our neighbours, have really large trees on our boundary and despite numerous requests, and undertakings from their side, neglected to care for, and maintain their trees causing a nuisance and repeated damage to our property.


Eventually one of their really large Bluegum trees, overhanging our property, fell over severely damaging our outbuilding, and our personal belongings stored in the building . 


As our neigbours are insured we were advised to institute a 3rd party claim for our damages.


The insurance company refuted our claim. 

What they said

We advise that your claim arises out of the South African Law of Delict, which means that for you to successfully claim against our Insured, you will need to prove that our Insured is legally liable for your loss. 

The burden of proof is on you to prove that our Insured is liable for your loss.


Our investigation is complete and with the information available we are now able to respond to your claim against our insured.


From the facts at our disposal our insured is not liable, there is no evidence to suggest that our insured is legally liable for the loss you suffered as the tree fell due to circumstances beyond our insured’s control and not due to our insured’s negligent actions.


We are refuting liability on behalf of our Insured and advise that any action against them will be defended.


You are urged to lodge a claim with your own insurers if you are so insured, alternatively to seek further legal advice.

Clear proof.

We provided the insurer with clear proof, with photographs, satellite imagery and diagrams that this tree, that fell on our building, and the other trees along our

communal boundary fence present a clear and present nuisance and danger to us, due to the fact that it was clearly not cared for, maintained and contained to their property. 

Unmoved and they take their time.

Some Insurance companies are staffed by "busy people" that are sometimes unmoved by our need to have our claim settled  and damaged goods replaced.  

Fighting someone bigger for a bigger cause!

There is a saying that goes  "It's not the size of the dog in the fight, but the size of the fight in the dog". 

We believe that determination, courage, and perseverance are more important than physical size or financial muscle when fighting for justice. 

The insurance conundrum

The reality is insurance companies rely on their deep financial pockets and large legal departments to ward off the little guy's claims!


When they refute legal liability on behalf of their insured, their client, the burden of proof is on you, the one suffering the injustice, to prove that their Insured client is liable for your loss. 

When they refute your claim!

The Ombudsman for Short-Term Insurance only covers disputes between an insured and their insurance company, they do not serve or protect a 3rd party claimant.


Insurance companies know legal action is prohibitively expensive for the average family or small business and that they could eventually wear you down and out financially.   


The most disturbing is, when they refute your claim, they will tell you that any action or attempt from you, to get justice, against their insured, will be defended by them. 


We intend to create a lobby group that will advocate for consumer protection for 3rd party insurance claimants.

We will publish podcast interviews with legal professionals that will dissect and discuss our stressful journey, and the difficulties we are experiencing. 


Our story will focus on the legal intricacies that arise when neigbours allow their trees on the communal boundary to overgrow onto, and damage your property. 


We will also publish interviews with local and international legal experts that will aim to educate the public about legal matters between neighbours.

But we are going to need some help!

We are inviting legal experts especially those that specialise in short term insurance claims to join our community and to offer our readers early stage advice and guidance to avoid wasting time and costly mistakes.

We are inviting peripheral service providers like structural engineers and quantity surveyors to provide us with a description of their areas of expertise, specialisation, the area they provide services in, and their contact details. 

In turn we will offer you opportunities to introduce yourselves to your target market and promote your specific areas of specialisation.  

As our website grow we will invite our readers to send us their stories and we wil do our best to  connect them with the most appropriate professionals for advice.
